 Skyline Properties Terms of Use

Welcome to Skyline Properties! These Terms & Conditions ("Terms") govern your access to our website ("Site") hosted on GoDaddy and the property management services provided via AppFolio (collectively, "Services"), whether via web or mobile interface. Your use of any portion of the Site or Services constitutes your agreement to these Terms.

1. Acceptance of Terms

By using the Site or Services, you agree to these Terms. If you do not agree, do not use them. Skyline may modify these Terms at any time and will post the updated date. Continued use after changes indicates acceptance.

2. Service Providers

• AppFolio powers our resident portal, lease execution, maintenance requests, and related property management functions.
   
• GoDaddy hosts our Site and provides web services. Use of those portions is also subject to GoDaddy’s Website Services Agreement and Universal Terms of Service.
   

3. Your Responsibilities

• You are responsible for internet access, devices, and any fees associated with use of the Site.
   
• You must maintain the confidentiality of your account credentials and are responsible for all activity that occurs under your account.
   
• You agree to provide accurate information during registration (if applicable) and keep it updated.
   

4. Acceptable Use

You may not:

• Reverse-engineer, misuse, scrape, or circumvent the Site or Services.
   
• Violate intellectual property rights or applicable laws.
   
• Engage in abusive activity such as spam, malware distribution, overloading systems, or unauthorized access attempts.
   
• Use AppFolio or GoDaddy platforms to compete with their services or create derivative offerings.
   

5. Third-Party Content & Links

We may link to or embed third-party services (e.g., AppFolio, Google Maps, analytics, payment processors). Your use of those services is governed by the respective providers’ terms. Skyline does not control third-party content and is not responsible for accuracy, reliability, or safety.

6. Lease Agreements & Payments

• Skyline’s website does not collect or process rental payments. All rental payments, deposits, application fees, and related financial transactions are completed securely through the AppFolio Resident Portal, which is linked from our Site.
   
• By using the AppFolio portal, you are subject to AppFolio’s Terms of Service and Privacy Policy, which govern all payment processing, electronic lease signing, and related resident services.
   
• Any discrepancies or issues with payments, application fees, or lease execution must be resolved directly through the AppFolio portal or with your property manager. Skyline does not control or manage those transactions through this Site.
   

7. Modifications & Termination

Skyline may modify, suspend, or discontinue the Site or Services at any time, with or without notice. You agree Skyline is not liable for such changes or termination.

8. Disclaimers

• The Site and Services are provided “as is” and “as available,” without warranties of any kind, either express or implied.
   
• Skyline disclaims liability for indirect, incidental, or consequential damages, including loss of data, profits, or business opportunities.
   
• Any reliance on Site content is at your own risk.
   

9. Indemnification

You agree to indemnify and hold harmless Skyline Properties, its affiliates, employees, and agents from claims, damages, or expenses resulting from your misuse of the Site, violation of these Terms, or infringement of others’ rights.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to conflict of law principles. You agree that any disputes arising under or relating to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Minnesota, and you consent to the personal jurisdiction and venue of such courts.

11. Enforcement

Skyline does not assume responsibility to you or others for any failure by Skyline to enforce any provision of these Terms. Our decision not to enforce shall not constitute a waiver of any right or provision.

12. Time Limitation on Claims

You agree that, regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to these Terms or your use of the Site or Services must be filed within one (1) year after such claim or cause of action arose, or it shall be forever barred.

13. Miscellaneous

• Assignment: You may not transfer these Terms without Skyline’s written consent. Skyline may assign these Terms without restriction.
   
• Severability: If any provision is deemed invalid, the remaining provisions remain enforceable.
   
• Entire Agreement: These Terms, along with our Privacy Policy and any referenced third-party agreements, constitute the entire agreement regarding use of the Site and Services.
